Terms of Service

By signing up for an account with Easy Eikaiwa you agree to observe the following terms and conditions. The same terms and conditions apply to all users of the system, including the account holder and their registered users.

These terms and conditions may be modified at our discretion, and can be found online at http://easyeikaiwa.com/terms

Account terms

  1. Free accounts
    1. Each individual may only sign up for one free account
    2. We reserve the right to cancel extra accounts opened by the same individual
      You may contest our claim of you having multiple free accounts, but we reserve the right according to our Privacy Policy to use our IP address logs, and the account holder email addresses to support our claim against you if we feel you are abusing this term of service.
  2. Paying accounts
    1. You may sign up for as maying paying accounts as you like, but only one sub-domain can be used per account, and one account per sub-domain.
    2. The first 30 days of all paying accounts are free
    3. All accounts can be cancelled at any time during the 30-day free trial, in which case no payments will be required
    4. On a day which we elect you will be asked to either enter your payment details in order to continue using your account, or to cancel your account.
      1. If you elect to enter your payment details you will be billed on the 30th day, and then on the same day of the month, every month, until you cancel your account.
      2. If you elect to cancel your account, it will be deleted immediately along with any information you have entered into it.

Cancellation and Termination

  1. To cancel your account, the account holder must use the account administration interface provided by the system
  2. Upon cancellation, all of your information including scheduled events and student contact details will be permenently deleted and can not be recovered. We take no responsibility for this information once you choose to cancel your account.
  3. We reserve the right to terminate the accounts of any individuals who abuse the terms of service at any time.

Copyright and Content Ownership

  1. The account holder retains ownership of all information and content entered into the system by the account holder and any users given login access to their account.

General Conditions

  1. You will not attempt to hack/crack into the system for any reason or by any means, or to circumvent the user authentication system
  2. You will not attempt to log into the system using “brute force” or any other malicious tactics to gain entrance to other users’ accounts.
  3. The system may only be used by human operators logged in legitimately with a web browser.
  4. Usage of the system by any means other than a direct connection with a web browser is prohibited. This applies to all software such as Google’s web accelerator which may result in the loss of data.
  5. We take no responsibility for the loss of any data caused directly or indirectly by users of the system or by ourselves, including intentional, malicious data loss, or unintentional, accidental data loss.
  6. We do not guarantee 100% uptime of our service and will not be held responsible for downtime caused by network outages, software failure, or the customer’s inability to connect to the internet for any reason.
  7. We do not promise that our product will make you more intelligent, successful, or attractive to the opposite sex, and nor do we claim that it will bring you inner peace or happiness.

Modifications to the Service and Prices

  1. We reserve the right to make changes and ammendments to our terms of service and our pricing plans after first notifying all account holders by email 30 days before hand and posting an announcement on our website.
  2. Features may be added, removed, or modified at any time at our discretion as we continue to develop and improve the service.
  3. Customers may not contest changes and improvements made to the system or claim entitlement to a refund for changes made to the system.

Payment, Refunds, Upgrading and Downgrading Terms

Payments

  1. Payments will be made in advance on the first of each month for that month’s service.
  2. Payment processing will be handled by a third party of our own discretion.
  3. We will not be involved in or held responsible for resolving issues between customers and the payment processor.
  4. A warning will be given to overdue accounts, but we reserve the right to terminiate overdue accounts at our discretion.

Refunds

  1. We do not give partial refunds for accounts cancelled before the end of the month.
  2. Refunds will not be given for “unused” accounts. It is up to the account holder to cancel the account if they no longer wish to use it.

Upgrading

  1. Upon upgrading to a higher pricing plan you will begin being billed for the new amount immediately and will be given access to the full range of services available to that pricing plan.

Downgrading

  1. Upon downgrading to a lower pricing plan you will begin being billed at the new rate immediately, and will be limited to the range of services offered by that plan.
  2. In downgrading an account, some data must be deleted in order to reduce the range of services, for example the number of available campuses or students. By downgrading you accept this term of service and we will not be held responsible for recovering any deleted data. (You will be shown which data will be deleted before your account is downgraded).

Support

  1. Free plans:
    1. No support of any kind is offered to free plans
    2. General questions directed to info@easyeikaiwa.com may or may not be answered at our discretion.
  2. Paying plans:
    1. Support is offered to paying plans by email only, and should be sent to support@easyeikaiwa.com
    2. We will endeavor to answer support emails by the next working day, which excludes Saturdays, Sundays, and all Japanese and Australian national holidays. Having said that, you may possibly receive a reply on the same day.
    3. We reserve the right to declare an issue as being resolved at our discretion and to discontinue further discourse on issues which we feel have become unproductive or tiresome.
